Terms and Conditions

Webdoctor.ie has taken great care in the development and presentation of this website and the material present on it. However, there may be inadvertent and occasional errors for which we apologise, but for which we can accept no liability.

Definitions

“You or yours” refers to you as the person who has submitted your personal information on this website agreeing to use the Online Medical Consultation service.

“We or our” refers to Webdoctor Ltd, incorporated in the Republic of Ireland with under Company Registration Number 536841, whose registered office is at Webdoctor Limited, 20 Knockmeenagh Road, Clondalkin, Dublin 22, Ireland.

“Website or Site” means the linked pages of Webdoctor.ie that allow an online consultation to be performed for the purpose of issuing private prescriptions.

Change to the Terms and Conditions

By using the site, you agree to be bound by these Terms. We reserve the right, in our sole discretion, to change, modify, add or remove portions of these Terms at any time.

Declaration

By agreeing to our Terms and Conditions and using the site, you declare you wish to take part in the online medical consultation service operated by Webdoctor Ltd through the Webdoctor.ie website. The online consultations are subject to the terms and conditions set out in this agreement.

You agree to register as an authorised user of the site and by doing so you warrant that you are over eighteen years of age or the legal guardian of the child you have registered and are resident in the Republic of Ireland. You agree to not disclose your authorisation credentials (username and password) to any third party. You agree not to register or complete online consultations for anyone other than yourself.

You undertake and warrant that all information provided by you is correct, true and complete.

Medication is prescribed in accordance with information you provide to our doctors through assessments on the website and by Webdoctor.ie account messages, email and by telephone. We rely on the information provided by you and therefore accept no liability for loss or damage arising from our service or medication prescribed if you supply incorrect or incomplete information.

You agree to promptly inform our doctors of any side effects of treatment and any other issues arising from treatments provided through the website.

You agree to inform your GP about medication supplied and advice given to you through the website.

We are not liable for any damage which may arise from your failure to inform your GP or other healthcare professional about treatment you receive from the website.

We are not liable for any damage which results from your failure to follow advice given on the website.

You accept the advice that the website does not replace your GP and that you should consult with your GP and other health carers when you are advised by our doctors and as need arises.

In the event that you do not fully understand the questions in the assessment part of the website or are unsure how you should answer those questions, or you do not fully understand the advice or information given to you on the website, you agree that you will seek clarification from the website doctors.

You agree that any medicine our doctors prescribe to you will be exclusively for your own personal consumption and not for any other person and you undertake not to supply any other person with any such medicine.

You agree that, before taking any medicine that our doctors have prescribed, you will read all of the information that the doctor has provided to you, both online and in printed form. You agree that you will read the manufacturer’s Patient Information Leaflet that accompanies the medicine and that you will follow any advice that the dispensing pharmacist provides to you.

Prescriptions are issued entirely at the discretion of the doctor. Webdoctor Ltd cannot guarantee a consultation with a doctor on the Webdoctor.ie website will result in a prescription being issued.

If any of these terms are held to be invalid or unenforceable then the validity and enforceability of the remaining provisions shall not be affected.

You give your consent for information about yourself, your health and your medical history including, but not limited to, the information you divulge as part of the online consultation assessment to be viewed and exchanged by and between Webdoctor Ltd employees and a Doctor working on Webdoctor’s behalf for the purpose of conducting a medical consultation. You understand this information may be exchanged electronically.

Online consultations made electronically from this Website will be dealt with by a Doctor as soon as possible. Webdoctor.ie is an online consultation service that relies on third party networks and technology for communication and we are unable to guarantee a time of arrival of consultation information to a Doctor or absolutely guarantee it will arrive at all.

The benefits provided under the Healthcare Plan will expire 12 months from the date of its purchase and must be used within this period. Any benefits not availed of within this period will be forfeited. The refund policy for the Healthcare Plans is set out below under the heading ‘Refund Policy’. The prescriptions available through the Healthcare Plan are limited to prescriptions for the treatments listed here.

Payments

You are responsible for providing valid credit or debit card details and in doing so you are authorising us to take payment in full for the service and warrant that you are authorised to use the card. Our pricing is clearly displayed on the website. Prices include post and packaging.

Refund Policy

Online Video Consultations

Online video consultation appointments may be cancelled or rescheduled free of charge if requested more than 24 hours in advance of the scheduled appointment start time. Patients will be charged in full for any consultations cancelled or rescheduled within 24 hours of the appointment start time. Patients have the ability to cancel an online video consultation themselves. All requests to reschedule must currently be made by emailing info@webdoctor.ie. Refunds, if applicable, can only be made to the original credit or debit card and take 1 to 10 working days to process.

Online Prescription Services

Cancellation and refund requests for online prescription services may be made within 3 hours from the time the purchase was made, or 3 hours into the next working day if the purchase was made outside our normal operating hours (Mon-Fri 8am-10pm, Sat-Sun 10am-6pm), the Cancellation Period.

Refunds, if applicable, can only be made to the original credit or debit card and take 1 to 10 working days to process.

Once the Cancellation Period is over, and if our doctors issue a prescription for you, no refund will be permitted.

If our doctors refuse your prescription request because it is deemed unsafe and/or medically unsuitable for you, you will be offered a safe alternative (if available), or a full refund will be provided to you. Please note that refunds can only be made to the original credit or debit card and take 1 to 10 working days to process.

If our doctors refuse to issue your prescription request because our doctors consider that the prescription service (rather than the prescription itself) is deemed unsafe and unsuitable for your medical needs, then the following shall apply:

  • If our doctors consider that a full consultation is necessary for the relevant medication request, you will be offered an online discount code that can be used towards such an online video consultation with one of our GPs, or,
  • If our doctors consider that the online video consultation format is deemed unsafe and/or unsuitable for your medical needs, you will be offered an option to take a refund and advised to attend your local GP instead. Please note that refunds can only be made to the original credit or debit card and take 1 to 10 working days to process.

If your request for a prescription is assessed by one of our doctors and you fail to provide the required medical information as requested in our questionnaire, and when prompted by the doctor, within 3 days of the date of your request (or if you supply incorrect or insufficient information), no refund will be permitted.

Home Health Test Kits

You have the right to cancel the contract for the Home Health Test Kit and receive a refund within fourteen days from the date on which you receive the product. In performing your right to cancel you are not required to give any reason for the cancellation. However, please inform us that you wish to cancel the contract by writing to us at info@webdoctor.ie. We will then acknowledge receipt of your cancellation instruction via email.

You will not be able to cancel the contract or be entitled to a refund for health protection and hygiene reasons in the event that the Home Health Test Kit has been opened or unsealed. If your Home Health Test Kit is clearly personalized or liable to deteriorate or expire rapidly then you will also not be entitled to a refund.

However, if you wish to cancel your contract for the Home Health Test Kit, you are required to return the unopened and untampered with Home Health Test Kit to us within 14 days from the day in which you contacted us at info@webdoctor.ie. Refunds, if applicable, can only be made to the original credit or debit card and take 1 to 10 working days to process. 50% of the RRP is deducted from the refund to cover some of the costs of the kit, which must be destroyed and cannot be reused.

Typically our Home Health Test Kits are shipped within 24 hours of purchase and are delivered within 7 days. However, in the event that you do not receive the product within the expected timeframe, please inform us of the delivery issue in writing by contacting us at info@webdoctor.ie. In the rare event that you do not receive the product within 30 days you may be entitled to a refund.

If you have any further queries in relation to this Refund Policy, for example, if you receive the wrong products or in the event that the products you receive are damaged or faulty, please email info@webdoctor.ie.

Healthcare Plans

You have the right to cancel the contract for a Healthcare Plan and receive a refund within fourteen days from the date on which you purchase the plan. In performing your right to cancel you are not required to give any reason for the cancellation. However, please inform us that you wish to cancel the contract by writing to us at info@webdoctor.ie. We will then acknowledge receipt of your cancellation instruction via email.

You will not be able to cancel the contract or be entitled to a refund if you begin using the respective Healthcare Plan during the initial fourteen days or anytime thereafter.

Webdoctor Ltd has taken care in the preparation of the content of this website. To the fullest extent permitted by the law, Webdoctor Ltd disclaims all warranties of any kind with respect to the content of this website.

Acceptable Patient Behaviour Policy

Here at Webdoctor, we believe that our patients have a right to be heard, understood and respected.
We also believe that our staff, both medical and non-medical, have the right to work in a safe environment, free from any potential abuse or harm caused by others. Our support staff and medical teams are dedicated to providing a safe, quality medical service and this is a two way process depending on the mutual respect and cooperation of patients.

In a small number of cases the actions of some patients become unacceptable because they involve the abuse of our staff and/or our processes. Aggressive or abusive behaviour includes language (whether verbal or written) that may cause staff to feel afraid or intimidated, and may include the use of derogatory remarks, rudeness and other menacing behaviour by whatever means. Unacceptable patient behaviour also includes unreasonable demands and/or unreasonable levels of contact.

As per our Acceptable Patient Behaviour Policy (a full copy of which is available on request), before we take any action, we will give the person the opportunity to modify their behaviour. If a patients’ behaviour is found to be unacceptable on subsequent occasions, it may result in removal from our service.

Exclusive jurisdiction of the Irish courts

The Site has been created and is controlled by Webdoctor Ltd in Ireland. These Terms will be governed by, and construed and enforced in accordance with, the laws of Ireland. You hereby unconditionally and irrevocably submit to the exclusive jurisdiction of the Irish courts.
